Spouses can enter into a special marriage agreement to choose a different regime, such as the separation of property and also set up a property fund by allocating some property to meet the needs of the family. The 1st paragraph of art. 191 cc provides: “Communion is dissolved by the declaration of absence or presumed death of one of the spouses, by the annulment, dissolution or termination of the civil effects of marriage, personal separation, judicial separation of property, due to a conventional change in the property regime, due to the bankruptcy of one of the spouses. "In the case of personal separation, the communion between the spouses is dissolved when the president of the court authorizes the spouses to live separately, or on the date of signing the minutes of consensual separation of the spouses before the president, as long as approved.
